What Are Anti-Dumping Measures? Their Role in Preventing Unfair Competition

10/26/2026

In international trade, low-priced imports do not always constitute unfair competition. Countries may differ in their production costs, efficiency levels, and market conditions.

However, in certain cases, the export of products below their normal value can cause injury to the domestic production sector of the importing country. This is where anti-dumping measures come into play.

What Is Dumping?

Dumping occurs when the export price of a product is lower than its normal value as determined under the applicable legislation.

In establishing the normal value, comparable domestic market prices in the exporting country and other methods provided for under the relevant regulations may be taken into account.

Therefore, the mere fact that a product is inexpensive does not prove the existence of dumping.

How Is the Dumping Margin Determined?

The dumping margin is determined by comparing the normal value with the export price.

For this comparison to be reliable, commercial conditions, levels of trade, taxes, delivery terms, and other factors affecting price comparability must be assessed in accordance with the applicable legislation.

The dumping margin is one of the key indicators in an investigation. However, it alone is not sufficient to justify the imposition of measures.

Material Injury and Causation

Anti-dumping investigations examine whether the domestic production industry has suffered material injury.

Indicators such as changes in production volume, sales volume, market share, price suppression, profitability, and employment are significant in this assessment.

Furthermore, a causal link must be established between the identified injury and the dumped imports. Ensuring that injury attributable to other economic factors is not imputed to dumped imports is essential for the objectivity of the investigation.

Do Anti-Dumping Measures Prohibit Imports?

Anti-dumping measures do not, as a rule, aim to completely prohibit imports.

Where the requisite conditions are met, anti-dumping duties may be applied to specific products and countries of origin.

The scope, rate, and duration of the measure are determined by the relevant investigation decisions.

Significance for Importers and Exporters

Anti-dumping measures can directly affect import costs and sourcing strategies.

For this reason, companies must regularly monitor the HS codes of the products they import, their countries of origin, and any measures currently in force.

Conclusion

The purpose of anti-dumping measures is not merely to make it more difficult for low-priced products to enter the market.

The fundamental objective is to take proportionate and well-reasoned measures within the framework of international trade rules in response to injury caused to domestic production by dumped imports that have been legally established.
